How BerryTalks collects, uses, shares, and protects personal data.

At BerryTalks (together with its affiliated companies, “BerryTalks”, “we”, “our” or “us”), we work hard to keep the personal data we handle safe and to be transparent about our data practices with our customers, users, and prospects.

1. Introduction

This Privacy Policy explains how we collect, store, use, and share personal data belonging to our “Customers”; businesses using our omnichannel communication portal (“Services”) to manage conversations with their own end-users across channels such as WhatsApp, SMS, email, Messenger, Instagram and voice, as well as users of our Services, attendees at our events, prospective customers or partners, and anyone who visits or interacts with our portal or website (such as https://berrytalks.com/, online ads, content, social media profiles, emails, or communications we control (collectively, “Sites”).

Providing personal data to us is always your choice. If you would rather not share your personal data, or would prefer it isn’t processed by us or our Service Providers (as defined below), simply refrain from providing it.

If you’re using the Services on behalf of one of our business customers, we recommend contacting your account administrator with any questions, since your organization controls how the portal is configured and used. By accessing our portal, using our Services, integrating with our systems, or otherwise sharing your personally identifying information with us, you agree to the practices described in this Privacy Policy.

This Privacy Policy may be updated from time to time, and any changes will appear on this page; where a change is significant, we’ll provide more visible notice. Questions or concerns about this Policy can be sent to [email protected].

2. Data collection

We collect information you provide directly (name, email, employer), Log Data (IP address, browser type, pages visited), and Cookies. We may also receive data from third-party integrations you connect to your portal account, or from partners. Third-party service providers help us deliver, secure, and improve the portal; we don't share your data with anyone outside this relationship.

3. Data usage

We may use our Customers’ personal data as needed to deliver our portal and its features; to meet our legal and contractual obligations; and to pursue our legitimate interests in maintaining and improving our Services, for example, understanding how our platform and campaigns perform, and gathering insights that help us allocate our resources more effectively; marketing, advertising, and selling our Services; providing customer service and technical support; and keeping our customers, users, visitors, prospects, ourselves, and our Services safe and secure.

If you’re located in, or using our Sites or Services from, a jurisdiction where “consent” is the only or most suitable legal basis for processing personal data as described here (whether generally or for specific categories of data you expect or choose to have processed by us or through the Services), then your acceptance of our Terms and Conditions and this Privacy Policy counts as your consent to the processing described in this Policy, unless applicable law demands a different form of consent. 4. Security of personal information

Protecting your Personal Information matters to us, and we work to put in place and maintain reasonable, commercially appropriate security measures suited to the nature of the data we hold on our portal, to guard it against unauthorized access, destruction, use, alteration, or disclosure.

5. Accessing and correcting your personal information

We recognize your right to access your personal information. You can access, update, correct, or request removal of the Personal Information you’ve shared with us by emailing [email protected] or contacting us by phone or post. To keep your information secure, we’ll take reasonable steps to confirm your identity before making any updates or deletions.

6. How can you opt out of use and disclosure of your information?

To have your Personal Information removed from our mailing list or database, contact us at [email protected]. Note that BerryTalks may keep archived copies of such information even after removal.

If you’d prefer not to receive promotional messages, you can let BerryTalks know at any time by emailing [email protected], adjusting your communication preferences in your account settings while logged in, or following the “unsubscribe,” “stop,” “opt-out,” or “change e-mail preferences” instructions included in the promotional message itself.

7. Data retention

We keep Customer personal data for as long as reasonably needed to build and grow our relationship with you and deliver our portal, Sites, and offerings; to meet our legal and contractual obligations; or to protect ourselves in the event of a dispute (for example, to satisfy laws around log-keeping, recordkeeping, and bookkeeping, and to have evidence of our relationship should any legal matter arise after you stop using our Services), all consistent with our data retention policy.

Unless applicable law or a specific agreement with you says otherwise, we’re not required to hold on to your personal data for any set period, and we may securely delete it or restrict access to it at any time and for any reason, with or without notifying you. 8. Data sharing

We share data only with Service Providers who help deliver the portal (hosting, analytics, payments, CRM, etc.), under confidentiality obligations, and when legally required.

Important Customer-Managed Interactions: Our portal allows Customers to communicate directly with their own end-users across channels. BerryTalks store the content of these interactions what's technically required to operate the Service.

Customers are solely responsible for their own data practices and legal compliance in these interactions.

9. Data security

We implement systems, applications, and procedures to protect your personal data and reduce the risk of theft, loss, damage, or unauthorized access or use.

Processing on behalf of business customers: When we process personal data on behalf of our business customers as part of the Services, that processing is governed by our agreements with those customers.

Our business customers are solely responsible for deciding whether and how to use our portal, for making sure everyone using BerryTalks on their behalf or at their request, including their own end-users, has been given adequate notice and, where necessary or advisable, informed consent for the processing of their personal data, and for ensuring that all legal requirements relating to the collection, recording, use, or other processing of data through our Services are fully satisfied. Our business customers are also responsible for handling any data subject rights requests raised by their own end-users or other individuals whose data they process through the portal.
